1. Introduction
These Terms and Conditions of Use (the "Terms and Conditions") apply to your use of this website (the “Website”). You agree to be bound by the Terms and Conditions unconditionally when accessing this Website.
 
2. Definitions and scope
Definitions
The following definitions have the same meaning whether they are singular or plural.
'HKSH' means a HKSH Medical Group Limited and/or its affiliates.
“Online System” means the Website, electronic forms or other web-based or app hosted by third party service providers for appointment bookings.
'Service' means service(s) offered by the HKSH under the Online System.
 
3. Contents of this Website
The Website is not intended to provide diagnosis, treatment or medical advice. All information/materials contained in this Website are provided for general information and reference only and are not intended as a substitute for medical professional help or advice. Individuals should consult their own doctors/healthcare provider for any matters concerning health problem, medical condition, treatment or needs that they may have.

Although every effort is made to ensure that the information/material within this Website is accurate and timely, it is provided for the convenience of the Website user only and no guarantee on accuracy and completeness can be provided. Information/materials within this Website are subject to change without prior notice.

The contents of other websites, services, goods or advertisements that may be linked from this Website are not maintained or controlled by HKSH. HKSH is therefore not responsible for the availability, content or accuracy of other websites, services or goods that may be linked from, or advertised on those websites.

4. Use of the Website
You use this Website at your own risk. You must evaluate, and bear all risks associated with, the use of any content, including reliance on the accuracy, completeness or usefulness of any content.  HKSH does not guarantee that the content of this Website will be error free or that this Website or the server that operates it is free of viruses or other harmful components.

Although HKSH will use reasonable endeavours to maintain the content of this Website, HKSH does not undertake to provide support or maintenance services for the content.
If your use of the Website results in the need for servicing or replacing property, material equipment or data, HKSH disclaims any responsibility or liability in relation thereto and will not be responsible for such costs, loss or damage.
 
5. Booking via Online System
The Services made available by HKSH booked through the Online System can only be used by you who have first read these Terms and Conditions and accepted them unconditionally such that these Terms and Conditions are deemed to be automatically incorporated into the contract concluded with the HKSH entity providing the Services without the need for your written transcription of the same. If you do not accept these Terms and Conditions, it is not possible to proceed with the booking.
 
Your booking via the Online System (including seminar booking) is treated as your request for an appointment at HKSH. You should be aware that your booking is not confirmed or guaranteed, and that your requested date and time may not be available. Upon receiving your request, HKSH staff members will contact you on the booking confirmation by email, phone or SMS. Our staff member may also contact you in the event of any changes to the requested date and time. HKSH cannot be held liable from any unsuccessful request or bookings made via this Online System.
Due to certain specific nature of the Services to be selected by you, additional terms and conditions and/or special arrangements may apply.  You are duly reminded to read and understand such additional terms and conditions when processing the booking for the Services through the Online System.  In case of any inconsistency, the Service-specific terms and conditions shall prevail over these Terms and Conditions.  By confirming the booking, you are deemed to have accepted such additional terms and conditions and to comply with special arrangements, if applicable.
 
By making a booking through the Website, you agree that:
  1. you have read these Terms and Conditions and has the authority to and does agree to be bound by them;
  2. you consent to our use of information in accordance with our Privacy Policy;
  3. you are over 18 years of age;
if you are under 18 years old, your parent or legal guardian agrees to the Terms and Conditions on behalf of you;- you are fully aware of the Service nature and agree with the Service-specific terms and conditions and to comply with special arrangements; and- you consent to the upload of his/her personal data on the Online System, in which the personal data might be viewed by you / HKSH and your attending doctor(s).

5.1 Your Rights and Responsibilities
The Online System helps you to find Services and to make the necessary bookings and collects payment in respect of the Services, and acts as an interface between you and HKSH.  There is a limit on the number of bookings allowed for each mobile number / email user account and there may be black-out periods when bookings cannot be made.  However, booking of certain Services may not be currently available under the Online System and you are required to make the relevant bookings via telephone, email or electronic form (where applicable).  Booking of certain Services may be subject to additional terms and conditions set out in the relevant section of the Online System.

You must ensure that the details and information provided for the booking are accurate, complete and adequate.  HKSH will accept the booking based on the information provided and does not verify or check the booking details so provided.  You shall bear all risks arising from any error in information provided for the booking, which may lead to cancellation of booking without refund and compensation and/or refusal of Services.

You are responsible for your activities on the electronic booking platform or HKSH website (financially, use of personal data or otherwise). HKSH is not responsible for any acts and/or activities in such regard. HKSH is not responsible for any booking failures or wrong bookings caused.

Any use of the booking services that is fraudulent or is in conflict with these Terms and Conditions or applicable laws, rules or regulations shall be reason(s) for cancelling the booking or refusing your access to the Services offered by HKSH.

If there is any change in the booking caused by HKSH, HKSH endeavours to inform you by phone or updating the booking via the electronic booking platform as soon as possible.  You should directly contact HKSH in case there are any questions / concerns in relation to booking and payment confirmation.

5.2 Confirming and cancelling bookings

5.2.1 Confirming
Upon submitting the booking, payment of deposit may be required for certain Services. After successful payment, a transactional code may be issued by third-party payment system that will confirm the payment of booking.  A notification with booking details will be sent to you and you should show the notification to HKSH for registration purpose.   A binding contract will come into existence between you and the relevant HKSH entity providing the Services after you paid the deposit payable (where applicable).

The amount of deposit paid will be deducted from the full amount payable for the services received at the consultation. The deposit cannot be applied to other treatment or services not related to the consultation booked under the relevant booking. If the total amount payable in respect of the consultation fees and medical services exceeds the amount of deposit paid, you are required to pay for the shortfall.

5.2.2 Cancellation and Refund
If you wish to make a cancellation via the Online System, cancellation made more than 72 hours in advance of the consultation date, the deposit (if applicable) will be refunded.  Subject to the discretion of HKSH, refund will be made to the original payment method. Cancellation made within 72 hours before the consultation is non-refundable (if applicable).

Cancellations and refund are NOT available for selected services.  Please refer to the remarks of the booking (if any).

If you fail to attend to receive the Services on the date specified in the booking whether with or without notice to HKSH for any reasons or events not caused by HKSH or its affiliate, HKSH will not refund the monies paid for the booking and will under no circumstances be liable for your costs or expenses arising therefrom including travelling and accommodation expenses.

5.2.3 Re-scheduling of booking
Re-scheduling of booking for less than 72 hours is available in very limited situations which are beyond your control and the consequences of which could not have been avoided even if all reasonable measures had been taken. This includes: terrorism, significant risks to human health such as the outbreak of a serious disease or natural disasters such as typhoons, floods, earthquakes or weather conditions which make it impossible to travel to HKSH.  In such event, HKSH might allow for a change or re-scheduling of booking, subject to the sole discretion of HKSH.

Re-scheduling of booking may NOT be available for selected services.  Please refer to the remarks of the booking.

For certain booking(s), re-scheduling might be available if you made the re-schedule requestfor more than 72 hours in advance of the consultation date, subject to the sole discretion of HKSH.

5.2.4 Substitution of Patient
No substitution of patient is allowed.

Your full name as stated on his/her identity document, to be presented on registration at HKSH, is required to be provided for the booking of Services.  HKSH will verify your identity with the booking name provided on electronic booking platform to ensure the Services is provided to the correct person.  HKSH may disallow any person who is not the person named in the electronic booking platform to receive the Services without any refund.

6. Pricing of Services
HKSH reserves the right to amend the price of Services at any time. HKSH endeavours to ensure that all the information and prices both on our Website is accurate, however occasionally changes and errors occur and HKSH reserves the right to correct prices and other details in such circumstances. You must check the current price and all other details relating to the arrangements that you wish to book before making the booking.

7. Cancellation by HKSH
HKSH will not cancel the confirmed booking, except for reasons of force majeure or failure of supplier(s) to provide the necessary supplies for the Services or other reasons beyond the control of HKSH. HKSH may cancel your booking as soon as it has notice of the event leading to cancellation. If HKSH cancels your booking for the situations mentioned, you may receive a full refund of the monies paid for the particular booking or a re-scheduling of the booking, subject to the discretion of HKSH.
 
HKSH reserves the final right to refuse Services and/or reject the booking in its absolute discretion.

8. Personal Data
HKSH is not responsible for any loss and damages arising from the payment process or booking failures, e.g. due to inadequate information provided during online booking.  Any personal data loss or leakage due to and arising from the booking and payment procedures shall NOT give rise to any obligation and/or liability on the part of HKSH.

9. Copyright
You acknowledge that this Website and all materials on the Website or provided in connection with the Services and HKSH, including without limitation the Website’s or HKSH’s design, text, graphics, sounds, pictures, software and other files, its look and feel, and the selection and arrangement thereof, (collectively, "Materials"), are our property and are subject to and protected by copyright or other intellectual property rights. The trademarks, service marks, trade names, and logos contained on the Website (collectively, "Marks") are the sole property HKSH or the relevant affiliate which is the owner of these Marks. You are granted a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Materials only for your personal and non-commercial use only (the “License”) and that HKSH accepts no liability in relation to your use.  You agree not to copy, modify, use, distribute, transmit, republish, sell, resell or exploit, for any purpose, any portion of the Website, Materials or Marks unless approved by HKSH in writing. Any unauthorised use of the Materials or Marks shall be breach of the License and the intellectual property rights of HKSH. All rights not expressly granted herein are reserved by HKSH and its licensors. The references to third parties or their copyrights, trademarks or other intellectual property do not constitute or imply affiliation with, endorsement, or recommendation by HKSH of the respective trademark owners. 
 
10. Disclaimer
Except as expressly set out in these Terms and Conditions, the Website, Online System and all the information, materials available on the Website are provided on an “AS IS” and “AS AVAILABLE” basis without any warranty (either express or implied) or implied term of any kind from the part of HKSH, including but not limited to any implied warranties or implied terms of satisfactory quality, fitness for a particular purpose or non-infringement.  All such implied terms and warranties are excluded.
 
HKSH specifically disclaims any warranty or representation that the Website, the Online System or any content and information will meet your requirements or that the Website will be timely, secure, error free or uninterrupted.  You should use the Website, the Online System and any information and content at your own risk. Any material downloaded or obtained from the Website is done at your own risk and you are solely liable for any damage or loss that results from such use or downloading.

By accessing the payment system of third-party payment system, you agree that HKSH will not be liable for any direct, indirect, incidental or consequential loss arising from the use of such third-party payment system, including but not limited to payment procedures, any delay or inability to use the payment system.

The exclusions and limitations contained in this clause apply to the extent permitted by law.

The total maximum liability of HKSH and its affiliates arising from the online booking shall be limited to the amount of deposit paid (if applicable) by you for the Services under one particular booking.
 
11. Applicable law
These Terms and Conditions are governed by the laws of Hong Kong. You agree that the Hong Kong Courts shall have exclusive jurisdiction to hear and determine any dispute (including non-contractual disputes or claims) arising from the interpretation of these terms.
 
12. Contract (Rights of Third Parties) Ordinance
A person who is not a party to this Terms and Conditions has no right to enforce any terms of this Agreement under the Contract (Rights of Third Parties) Ordinance (Cap. 623).
 
13. Miscellaneous Provisions
If any provision of these Terms and Conditions (or part of any provision) is found by any court or other authority of competent jurisdiction to be invalid, illegal or unenforceable, that provision or part provision shall, to the extent required, be deemed not to form part of this agreement and the validity and enforceability of the other provisions shall not be affected.
 
All interpretations of these Terms and Conditions shall be at the sole and absolute discretion of HKSH.
 
If the English version of these Terms and Conditions conflicts with the Chinese version, the English version shall prevail. In case of dispute over the interpretation of these Terms and Conditions, HKSH’s decision is final.
 
Any changes to these Terms and Conditions shall be effective immediately upon posting.





Privacy Statements
 
HKSH is committed to protecting its patients’ privacy. This statement applies to the privacy of users of this Website including the Online Booking and Seminar Booking systems. All personal data collected from you on the Website / Online Booking system / Seminar Booking system will only be used for the specific purposes mentioned at the time of collection or for purposes directly related to facilitate you in making an appointment or general enquiries.
 
Your personal data will be kept confidential and will not be disclosed to any other person without your consent. Your personal data may also be disclosed where HKSH is required to do so by law.
 
Please read this Privacy Statement carefully before accessing this Website.  By accessing the Website and/or booking the Services via the Online System, you agree to the terms of this Privacy Statement and the use of personal information as described in this Privacy Statement.
 
1. Information collection
1.1 In order to book the Service, HKSH may collect your full name (Chinese and/or English), identity card number, travel document number, date of birth, phone number, address, email address (where applicable), which are specifically and voluntarily provided by you to proceed to submit the booking and/or payment (including payment via third-party payment system).  HKSH will store and maintain your personal information that is provided.  If the booking is made on behalf of another person, the person making the booking should have obtained your proper consent before supplying his/her personal information for booking.
 
1.2 Upon arrival at HKSH, HKSH may collect your personal information prior to the Services to complete your registration process, including your full name (Chinese and/or English), identity card number, travel document number, date of birth, phone number, address, email address (where applicable).  Such personal information will be checked against the information provided for the booking via the Online System.  HKSH will also store and maintain your personal information as patient record.
 
1.3 As your healthcare provider, HKSH may ask you to provide your personal data (including health information) or obtain from any appropriate third party regarding your medical history and any relevant information for your health care purposes and/or generally for medical care and treatment purposes and/or for the purposes stated below.

2. Information use
2.1 HKSH uses your personal information for the purposes stated at the time of collection.
 
2.2 HKSH will also use your personal information and history of receiving Services to send out SMS reminders for the up-coming appointments of Services.
 
2.3 Your personal information (including biometric data) may be used by HKSH for anonymised research and service quality control purposes.
 
2.4 To the extent permitted by applicable laws and regulations on data privacy protection, HKSH may also use your personal information for direct marketing purposes, or to send materials and information on medical and health issues, or communications and notifications regarding services provided by HKSH.  HKSH may contact you by telephone, SMS and text / picture / video message where necessary.
 
3. Disclosure of information to third parties
3.1 HKSH may provide your personal information to other entities within HKSH for planning and providing Services to you.
 
3.2 By accessing the third-party electronic platforms during the booking process, the personal information that is provided shall be transferred to such third-party service providers for the purpose of completing the booking, system maintenance, or directly related purposes.
 
3.3 For providing healthcare services to you and the uses stated above, HKSH may transfer your personal data to other doctors/healthcare providers/third-party service providers who require it for purposes for providing and supporting healthcare services.
3.4 Personal information may be disclosed to law enforcement, regulatory, or other government agencies, or to other third parties, in each case to comply with legal or regulatory obligations or requests.
 
3.5 By voluntarily providing your personal information, you are consenting to the disclosures described above.

4. Information Retention
HKSH will retain the personal information provided for a reasonable period of time to implement the purposes for which such personal information is collected or to comply with the applicable laws, regulations and regulatory requirements or rules of Hong Kong.  The personal information would include but not limited to your name, email address, phone number, date and year of birth etc.

5. Data Access and Correction
To access and correct your personal information, please send a written request to Health Record Unit of HKSH by email (recordenquiry@hksh.com) subject to a reasonable fee.
 
6. Transfer of Personal Data outside Hong Kong
If necessary, HKSH may transfer the personal data to places outside the Hong Kong Special Administrative Region for carrying out the purposes, or the directly related purposes, for which the personal data were collected.  All the transfer of those personal data will be carried out in compliance with the requirements of the Personal Data (Privacy) Ordinance of the Laws of Hong Kong.
To safeguard against any forms of malware attacks and data breaches, please use the smartphone securely at all time and review the permissions granted from time to time.
If there is any inconsistency between the English version and the Chinese version, the English version shall prevail.
 
Direct marketing or receiving any direct marketing materials
With your consent, HKSH might send you direct marketing materials or messages.
Any changes to this privacy statement shall be effective immediately upon posting.
